Be ticket clever

  1. Introduction

1.1. These Terms and Conditions ("Conditions") set out the Agreement between you and us, and identify your responsibilities to us and our responsibilities to you when you use our ticketclever Service you agree to be bound by these Conditions whenever you use ticketclever.

1.2. ticketclever is an agent for the Train Operating Companies and is only responsible for the delivery of your ticket. Tickets purchased by you from ticketclever are accepted by Train Operating Companies operating advertised services. Under 5s may travel free when accompanying a ticketclever customer. Please note that staff and agents have no authority to make individual exceptions to these Conditions or the National Rail Conditions of Travel, which you can view and download from the National Rail website http://www.nationalrail.co.uk/times_fares/46427.aspx. The Rail Conditions set out your rights and any restrictions to those rights with respect to your journey (for instance in relation to delayed departure). We are not responsible for any loss or damage to you due to bookings made through the ticketclever Service, this includes but is not limited to, delays, cancellations or disruptions to journeys.

1.3. When using National Rail services, you will have to abide by the Railway Byelaws. You can a get free copy of these at most staffed National Rail stations, or view and download a copy from the Department for Transport website https://www.gov.uk/government/publications/railway-byelaws.

1.4. At the point of sale of the ticket we will also inform you about any additional conditions or restrictions that apply to the ticket that you are purchasing. Please ensure you are aware of these as if you do not have a valid ticket for the service that you intend to use, and within the class of ticket that you have purchased, you will have to pay the correct fare, and you may have to pay a penalty if you travel without the correct ticket.

1.5. The ticketclever Service should only be used by individuals for their own personal booking requirements and not in the course of running a business.

2.1. ticketclever and ticketclever.com are trading names of Global Travel Ventures Ltd whose registered office is at One St Aldate's, Oxford Town Hall, Oxford, OX1 1DE with company registration number 07864821.

3.1. We take all reasonable measures to ensure that the times, fares and information that we provide are correct. However, despite our efforts, we cannot guarantee that all information is correct, as this information is provided to us by a third party rail information provider. Where we become aware of an error, we will take reasonable measures to rectify it. If you have purchased tickets which are subject to an error on the part of ticketclever, we will refund these in full.

3.2. If you purchased a ticketclever deal, (two or more tickets for your journey because our system worked out that the combination is cheaper than other alternatives), please note that the National Rail Conditions of Travel state that when using multiple tickets for a journey, the service(s) you travel on must call at all of the stations listed on the tickets. Together these tickets will cover your entire journey using the itinerary provided by us. The itinerary in your booking confirmation email lists the correct service(s) to travel on with the tickets provided and we recommend that you use these service(s).

3.3. If there is a delay that causes you to miss a connection, or you travel on a different service in respect to a journey as set out in clause 3.2. the Train Operating Company is entitled to charge you the difference between the fare you paid and the cheapest valid fare for the service concerned.

3.4. We use reasonable care and skill in carrying out our ticketclever Services to you. However, we make no representations about the suitability of the information, products and services provided by us as part of the ticketclever Services for any purpose and we do not accept liability for your reliance on any information supplied by us as part of the ticketclever Services except to the extent that such information is provided negligently.

3.5. We are not responsible for any losses incurred through any breach of these Conditions even if we are made aware of such possibility. We will not be liable for any losses linked to any business of yours, such as lost profits or business interruptions.

3.6. The total aggregate liability of ticketclever for any loss that you suffer arising out of your use of our ticketclever Services is limited to the total value of the transaction under which your claim arises.

3.7. We may use your personal information as set out in our Privacy Policy.

3.8. If you or we fail to enforce rights under this agreement, it will not prevent you or us taking further action.

3.9. Nothing in these Conditions shall prejudice your statutory rights as a consumer.

  1. Use of ticketclever website

4.1. We can suspend, restrict or stop providing the ticketclever Service to you in whole or in part in the following circumstances:

  • If we believe your ticketclever account or booking is being used in a way we do not allow under these Conditions;
  • If we believe you have paid or are trying to pay using a stolen or otherwise barred or false payment card or if the payment card transaction is at some time charged back to us.

4.2. We may make changes to the ticketclever Service at any time and we can make changes to or introduce new terms to these Conditions at any time. If possible we will give reasonable notice of these changes. The changes will apply when we publish details of them in a way which we consider is reasonable, for example by displaying messages on our website and/or your online account. The Conditions will be available on the website at all times. By continuing to use the ticketclever website, you agree to these changes. If you are not happy with any of these changes you should cease to use ticketclever.

4.3. ticketclever is only available for adults aged 16 or over.

4.4. You must have authority to use the payment card you supplied to enable payments to us through the ticketclever Service.

4.5. The billing address for the card payment you supply must match the address on record for that card.

4.6. Where the ticketclever Service provides details of fares which represent the cheapest published fares on the date and at the times selected, in many cases there may be higher fares available.

4.7. You confirm that you will be financially responsible for any bookings which are made using the ticketclever Service and for all reasonable losses which we suffer as a result of a breach of these Conditions.

4.8. You agree to use the ticketclever Service in a lawful way. You must not modify, copy, reproduce, publish, transfer or sell any information obtained from the ticketclever Service.

4.9. Your ticketclever account is only for your personal use. You are solely responsible for activity that occurs on your account.

4.10. These Conditions are governed by English law and shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

5. Issue of Tickets

5.1. We cannot confirm the price of any tickets that you wish to buy until they are confirmed by us in your basket. Some tickets have limited availability and although we check the availability before showing you the fare quotation in your basket, we cannot guarantee their availability until they are confirmed by us in your basket. Your payment card will not be charged until you have confirmed your order.

5.2. Once your booking has been completed, we will confirm the booking by email to the email address that you provided on the ticketclever site. We will then supply the tickets to you using the method you selected when you made your booking:

    • Collection at the station - We offer the choice to collect your tickets from a variety of stations. You need to ensure you have the booking reference number and the payment card used to make the purchase as identification, when required. You need to ensure you allow sufficient time to collect your tickets prior to boarding the service. You should contact station staff if you require assistance, if, however, there are no staff present at the station, you should board your service and make yourself known to the service staff as soon as possible;
    • Postal Delivery - Subject to system availability (which may be outside of our control), we offer the choice to have tickets posted to you via Royal Mail 1st Class if the booking has been made more than four days in advance and prior to 5pm on that day. We will not be liable if you have made an error in the delivery address you have supplied us.

5.3. It is your responsibility to check your tickets when you receive them to ensure the travel information is correct. If you believe the information is different to the information you provided at the time of booking you must contact us to advise of this difference.

5.4. Prior to boarding the service, you must ensure you have a valid ticket for your entire journey. If you can't produce a valid ticket when requested, you may have to purchase an appropriate ticket and maybe subject to a penalty fare. Our service may provide you with two or more tickets for your journey and together these will cover the entire journey. The condition of you using these combinations of tickets for a journey is that the trains you are travelling upon must call at all of the stations listed on all of the tickets. Therefore, it is not allowable to travel on alternative services that just pass through them without stopping. Please refer to clauses 3.2 and 3.3.

6. Ticketclever website on mobile device

6.1. The ticketclever website has been optimised to work on your mobile device to enable you to use the ticketclever booking service in conjunction with these Conditions.

6.2. We have endeavoured to ensure the ticketclever website works on all compatible handsets, however, due to variety of handsets available we can't offer technical help on an individual basis.

6.3. You are required to have a data connection to be able to use the ticketclever website on your mobile device.

6.4. Data charges might be applicable for the use of the ticketclever website on your mobile device depending on your individual phone package, it is your responsibility to check your tariff information and pay for any charges that are incurred. If you use the ticketclever website on your mobile device abroad your data charges may be considerable higher.

6.5. It is your responsibility to ensure you have sufficient connectivity when using the ticketclever website on your mobile device. We cannot be held accountable for any disruption during the booking process due to low connectivity on your mobile device.

6.6. If you have any queries about your data package or connectivity issues, please contact your network provider prior to using the ticketclever website on your mobile device.

6.7. The ticketclever website may not be available on some handsets and use may be restricted due to individual handset settings.

6.8. The ticketclever website can be used to store personal information so it is your responsibility to ensure your mobile device is protected with a secure PIN or password so that the information stored in ticketclever website on your mobile device cannot be accessed by any other party.

7. Registering as a User

7.1. You will receive a welcome email once you have registered your account on the ticketclever website.

7.2. The ticketclever Service is intended for your personal use only. You are responsible for maintaining the integrity of your account, which includes keeping passwords and user information confidential. You are responsible for all activity which occurs on your account.

8. Changes, Cancellations and refunds

8.1. Some tickets may be cancelled by you and a refund issued, or you may be able to change the time of your train. This will depend upon the type of ticket that you have bought. The Train Operating Companies decide on the rules with regard to refunds, amendments and cancellations. This information will be made available to you when you book your ticket. You should check it to ensure that the ticket will meet your requirements.

8.2. The fees charged for refunds and/or changes are determined by the Train Operating Companies which can be found in the ticket terms and conditions during the booking process.

8.3. Your request will normally be processed within 28 days of our receipt of your application. If the refund is approved we will return the amount to the payment card linked to your account (minus a £10 administration fee per ticket, if applicable). Please allow up to 5 working days for the amount to appear within your account.

8.4. If we have reason to believe a request is fraudulent we reserve the right not to process a refund, cancel, replace or make any changes to the ticket.

8.5. If the service on which you have booked a ticket for is cancelled or severely disrupted, you may be entitled to compensation or a refund. Unfortunately, we are not permitted to issue compensation or refund tickets for cancelled or disrupted journeys, you must contact the relevant Train Operating Company.

8.6. If you have requested a Postal Delivery and the tickets fail to reach you in time or are lost in the post, you will be refunded the full purchase price of those tickets once you have provided proof of repurchase of tickets to travel on that same journey, on the same date and with the same circumstances.

9. Other Terms

9.1. We will update these Conditions periodically, with an updated version being published on the website and any changes coming into effect once published. If you do not accept the Conditions you will not be able to proceed with your booking.

9.2. The amounts quoted on the ticketclever Service are in pounds sterling (£).

9.3. You agree that no joint venture, partnership, employment or agency relationship exists between you and us through your use of the ticketclever Service.
